These Terms of Use ("Terms") constitute a legally binding agreement between you and the Developer ("we", "us", "our", or "Developer") regarding your use of the Vesper mobile application ("App"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
Vesper is a mobile application that provides:
You must be at least 13 years of age (or the applicable age of digital consent in your jurisdiction) to use this App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have obtained parental or guardian consent to use this App.
Parents or guardians are responsible for monitoring their children's use of the App and ensuring compliance with these Terms.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on devices you own or control, solely for your personal, non-commercial use.

The App uses Apple's App Store and RevenueCat to manage subscriptions. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
You retain all rights to any content you create within the App, including your prayer requests and responses, your personal journal entries, and your Bible verse assessments and memorization progress. By using the App, you grant us a license to use, store, and process your data as described in our Privacy Policy. All your prayer journal data is stored locally on your device and is not accessed by us unless you explicitly choose to back it up to iCloud.
You agree to provide accurate, current, and complete information during the onboarding process and to update such information to maintain its accuracy.
Certain features of the App require a paid subscription ("Premium Features" or "Vesper Pro"). These features include:
Subscriptions are processed through Apple's App Store and are subject to Apple's terms and conditions.
Current subscription options:
We may offer free trial periods for Vesper Pro. You may be charged once the trial period ends unless you cancel before the trial expires. We reserve the right to modify or cancel free trial offers at any time.
We reserve the right to change subscription pricing at any time. For existing subscribers, we will provide at least 30 days' notice before any price increase takes effect. Price increases will not apply to your current subscription period if you purchased before the change.
The App, including all content, features, functionality, software, design, text, graphics, logos, and underlying technology, is owned by the Developer and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
Bible verses and content in the App are sourced from public domain sources and authorized translations. We respect intellectual property rights and expect users to do the same.
You retain full ownership of all content you create within the App, including your prayer requests, personal journal entries, and memorization notes. Such content is stored locally on your device and is not accessed, used, or transmitted by us unless you explicitly grant permission.
"Vesper" and associated logos are trademarks of the Developer. You may not use these trademarks without prior written permission.
THE APP IS NOT INTENDED TO PROVIDE MEDICAL, MENTAL HEALTH, PSYCHOLOGICAL, OR PROFESSIONAL SPIRITUAL GUIDANCE. The prayers, Bible verses, and content provided are for personal spiritual reflection and informational purposes only and should not be considered a substitute for professional mental health counseling or therapy, medical diagnosis or treatment, guidance from qualified clergy or spiritual advisors, or professional psychological or psychiatric care.
If you are experiencing mental health difficulties, depression, anxiety, or thoughts of self-harm, always seek the advice of qualified healthcare providers and licensed mental health professionals. Never disregard professional medical advice or delay seeking it because of content in this App.

TO THE MAXIMUM EXTENT PERMITTED BY LAW (SUBJECT TO MANDATORY CONSUMER PROTECTION LAWS FOR EU CONSUMERS), THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; WARRANTIES REGARDING ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT; WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; OR WARRANTIES THAT GENERATED PRAYERS WILL MEET YOUR SPIRITUAL OR PERSONAL NEEDS.
EU Consumer Notice: If you are an EU consumer, this disclaimer does not affect your statutory rights under applicable consumer protection laws, including rights to conformity of digital content and services under Directive (EU) 2019/770.
For EU Consumers: Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, any liability that cannot be excluded or limited under applicable consumer protection laws, or breach of the mandatory conformity requirements under EU law.
Subject to Section 10.1, we shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, revenue, or data; loss of goodwill or reputation; business interruption; personal injury or emotional distress (except where caused by our negligence); spiritual harm or religious offense; or any other intangible losses, even if we have been advised of the possibility of such damages.
Subject to Section 10.1, our total liability to you for all claims arising out of or relating to these Terms or your use of the App shall not exceed the greater of: (a) the amount you paid to us in the twelve (12) months preceding the claim, or (b) one hundred euros (€100.00).

We are not responsible for the availability, accuracy, or content of third-party services, their privacy practices or terms of service, or any damages or losses caused by third-party services. Your use of third-party services is governed by their respective terms and privacy policies.
We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice, for any reason. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App. However, we will attempt to provide notice of material changes.
We may revise these Terms from time to time. The "Last Updated" date at the top of these Terms indicates when they were last revised. Material changes will be notified through the App or via email (if provided). Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.
You may stop using the App and delete it from your devices at any time. Deleting the App does not automatically cancel paid subscriptions — you must cancel through your Apple App Store account settings.
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms or engage in unauthorized or illegal activity.
Upon termination, all licenses granted to you will immediately terminate and you must cease all use of the App. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, and limitations of liability. Your locally stored data will remain on your device until you delete it.
The App is controlled and operated by the Developer and is available worldwide. We make no representation that the App is appropriate or available for use in all locations. Access to the App from territories where its content is illegal is prohibited.
We strive to make the App accessible to all users, including those with disabilities. If you experience any difficulty accessing any part of the App, please contact us and we will work with you to provide the information or service you seek through an alternative communication method.
We welcome feedback, comments, and suggestions for improvements to the App. You acknowledge and agree that if you submit Feedback, we may use it without restriction or compensation to you, and you hereby grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such Feedback into our products and services.
If you access the App via Apple's App Store, you acknowledge that:
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if that is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App and supersede all prior negotiations, representations, and agreements, whether written or oral.
For users in the European Union, these Terms shall be governed by and construed in accordance with the applicable EU country laws, without regard to its conflict of law principles. You are entitled to the protection afforded to consumers under EU consumer protection laws.
For users outside the European Union, these Terms shall be governed by and construed in accordance with applicable laws, without regard to its conflict of law principles.
